Terms and Conditions of Sale
1. Purpose and scope
These terms and conditions of sale (the "Terms") govern orders placed on the DolcePick platform (dolcepick.com) between a Buyer and a Seller (professional pastry chef) for the purchase of limited-edition pastries ("drops").
DolcePick is a platform operator: it connects Buyers and Sellers and provides the booking, secure payment, and order tracking tools. The contract of sale is concluded directly between the Buyer and the Seller.
Any order placed on the Platform implies the Buyer's express and unreserved acceptance of these Terms.
2. Definitions
Platform: the DolcePick service, operated by Ollabot LLC (see the Legal Notice).
Seller: the professional pastry chef who offers their creations as drops on the Platform.
Buyer: any natural or legal person who places an order on the Platform.
Drop: a limited-edition sale of a product, available in limited quantities for a defined period of time.
Pickup point: the location indicated by the Seller (at the Seller's premises or at a meeting point) where the Buyer collects their order.
3. Drops
Each drop shows the product, its price, the available quantity, and the pickup or delivery arrangements defined by the Seller. The information (recipe, allergens, composition) is provided under the Seller's responsibility.
Quantities are limited: the order is only confirmed if the product is available at the time of booking.
4. Order and payment
1. The Buyer books the product and creates an order awaiting payment.
2. Payment is made online, securely, by debit or credit card, Apple Pay, or Google Pay, through the payment provider Stripe. No payment is collected before the Buyer confirms.
3. The order is only final once payment is confirmed. Until the payment is confirmed, the Buyer may cancel the order at no cost.
4. An order confirmation is sent to the Buyer in their "My Orders" area.
5. Prices and taxes
Prices are shown in euros, all taxes included, for the total amount due at the time of the order (unit price × quantity, after any discounts). Any applicable taxes are collected at payment and remitted in accordance with applicable regulations.
6. Order pickup
The order must be collected at the stated Pickup point during the pickup window defined by the Seller (date, time and location provided in the order).
On the day of pickup, the Buyer shows the QR code of their order to the Seller. The QR code is personal: presenting it counts as proof of collection.
Because the products are fresh and made to order, pickup times cannot be rescheduled. After the pickup window has passed, the order is deemed abandoned and the product may be put back on sale.
7. Right of withdrawal
Consumers residing in the European Union: the 14-day right of withdrawal provided by European Directive 2011/83/EU (transposed in France in Articles L221-18 et seq. of the French Consumer Code) does not apply to the products offered on the Platform: they are fresh, perishable foodstuffs prepared to order, expressly excluded from the right of withdrawal by Article 16(d) of that Directive (Article L221-28, 5°, of the French Consumer Code).
Consumers residing in the United States: US federal law does not provide a general right of withdrawal for online purchases; since the products are also fresh and prepared to order, no return or withdrawal is provided, without prejudice to any rights that the legislation of the consumer's state of residence may provide.
8. Cancellations and refunds
Before payment: the Buyer may cancel their order at any time, at no cost, from "My Orders".
After payment: if the Seller cancels the order or is unable to prepare it (unavailability, production issue, cancelled drop), the Buyer is fully refunded to their original payment method. The refund is initiated within 48 hours and credited according to the card issuer or wallet processing times (usually 5 to 10 business days).
A defective or non-conforming product must be reported to the Seller through DolcePick support (contact@dolcepick.com) within 24 hours of pickup.
9. Liability
The Seller is solely responsible for the quality, conformity, and hygiene of their products, and for the accuracy of the information they publish (ingredients, allergens).
The Platform undertakes to provide a reliable service: booking, payment, and order tracking. Its liability cannot be engaged for the products themselves or for any failure by the Seller.
10. Personal data
The data collected when ordering (email, orders, loyalty points) is processed to provide the service. It is never sold or used for advertising purposes.
In accordance with the GDPR, the Buyer has rights of access, rectification, erasure, restriction, objection, and portability, exercisable at contact@dolcepick.com, as well as the option to delete their account directly in the app. For more details (sub-processors, retention periods, cookies), see the Privacy Policy.
11. Governing law and disputes
These Terms are governed by the laws of the United States of America, and more specifically by the laws of the State of New Mexico (the state of incorporation of the company operating the Platform, Ollabot LLC), as well as by applicable US federal law.
For consumers residing in the European Union, this choice-of-law clause does not deprive them of the mandatory consumer protections guaranteed by European Union law and by the law of their state of residence (in particular the Rome I Regulation and Directive 2011/83/EU), under the conditions set out in those instruments.
In the event of a dispute, the Buyer is invited to contact DolcePick support (contact@dolcepick.com) to seek an amicable solution. Failing agreement, the courts of the State of New Mexico (United States) have jurisdiction; consumers residing in the European Union retain the right to bring their dispute before the courts of their state of residence (Brussels I Regulation (recast)).
